Terms of Service

Effective date: June 12, 2026

These Terms of Service (the “Terms”) govern your access to and use of the HireCue desktop application, the account portal at account.hirecue.ai, and the website hirecue.ai (together, the “Service”). The Service is operated by Yasha Limited (registration no. HE 419811), Office 908H, 9th floor, Nicolaou Pentadromos Center, Limassol 3312, Cyprus (“HireCue”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

HireCue is a real-time AI assistant for interviews. The desktop application transcribes audio on your device in real time and uses third-party AI models to suggest answers in a private on-screen overlay. The Service also includes optional features such as a local knowledge base, screenshot-based questions, and automatic updates.

2. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your country, if higher) and able to enter a binding contract to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it up to date. One account is for one person; accounts may not be shared or resold.

3. Free plan

We may offer a free plan or trial with limited usage. Free usage limits, included features, and availability may change at any time. A free plan does not require a payment method.

5. Cancellation and refunds

You can cancel your subscription at any time in the account portal. Cancellation takes effect at the end of the current billing period; you keep paid access until then and are not charged again. Refunds are handled as described in our Refund & Cancellation Policy, which forms part of these Terms.

6. Fair use and usage budgets

Features described as “unlimited” are subject to fair, personal use and to safeguards against abuse, automation, and resale. Plans that include usage budgets for specific answer modes behave as described on the pricing page: when a budget is exhausted, the Service falls back to the next available mode rather than cutting you off. We may adjust technical limits to protect the integrity of the Service.

7. Acceptable use — and your responsibilities

You agree not to:

Your responsibility for how you use HireCue. The Service processes live conversation audio. Laws on recording and processing conversations differ by jurisdiction, and many require the consent of all participants. Separately, interviews, examinations, and assessments may be governed by rules, contracts, or policies of the organizations that run them. You are solely responsible for ensuring that your use of the Service — including capturing or processing audio of other participants — complies with the laws that apply to you, for obtaining any consents required, and for any rules, agreements, or policies you are subject to. HireCue does not encourage or condone use of the Service in violation of any of the above, and we may suspend accounts used unlawfully.

8. AI output

Suggestions are generated by artificial-intelligence models. AI output can be inaccurate, incomplete, or inappropriate for your situation, and identical inputs may produce different outputs. The Service is provided for informational purposes; it is not professional, legal, or career advice. You are responsible for evaluating output before relying on it. We make no promise of any outcome, including interview or hiring outcomes.

9. Your content

You retain all rights to the content you provide — audio, documents in your knowledge base, prompts, and settings (“Your Content”). You grant us the limited rights needed to operate the Service: to process Your Content in real time, including through the third-party providers listed in our Privacy Policy, solely to provide the Service to you. Transcripts and knowledge-base files are stored locally on your device, not on our servers. We do not use Your Content to train AI models.

10. Our intellectual property

The Service, including the application, website, design, and branding, is owned by HireCue and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the application on devices you control, for your personal use, subject to these Terms. Feedback you choose to send us may be used without restriction or compensation.

11. Third-party services

The Service depends on third-party providers (such as payment processing, speech-to-text, and AI model providers). Their availability is outside our control, and their processing of data is described in our Privacy Policy.

12. Updates, changes, and availability

The application may download and install updates automatically. We continuously develop the Service and may add, change, or remove features. We aim for high availability but do not guarantee uninterrupted operation, and the Service may be unavailable due to maintenance, third-party outages, or events beyond our control. If we discontinue the Service entirely, we will give reasonable notice and refund the unused portion of any prepaid period.

13. Term and termination

These Terms apply while you use the Service. You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the Service or other users; where practical, we will notify you and, except in cases of your material breach, refund the unused portion of any prepaid period. Sections that by their nature should survive termination (including 8–10 and 14–17) survive.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING MANDATORY CONSUMER RIGHTS IN YOUR COUNTRY OF RESIDENCE.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA; AND (B) OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR INTENT OR GROSS NEGLIGENCE.

16. Indemnification

You will indemnify and hold HireCue harmless from third-party claims, and related costs and reasonable legal fees, arising from your breach of Section 7 (Acceptable use), including any failure to obtain consents required for audio processing.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-law rules. Disputes will be resolved by the courts of the Republic of Cyprus, except that consumers may also rely on the mandatory consumer-protection laws, and bring claims in the courts, of their country of residence.

18. Changes to these Terms

We may update these Terms from time to time. For material changes we will give you notice (for example by email or in the application) at least 14 days before they take effect. If you continue using the Service after the effective date, the updated Terms apply; if you do not agree, cancel your subscription before that date.

19. General

If any provision of these Terms is found unenforceable, the rest remains in effect. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and the Refund & Cancellation Policy, are the entire agreement between you and us regarding the Service.
